In reality, the law distinguishes between volume levels and the "nuisance" factor, and you can actually be fined at any time of day if the noise is deemed unreasonable.
1. The Two Types of Noise
- Disturbing Noise: This is "objective" and measurable (decibels). It is noise that exceeds the ambient (background) sound level by a certain amount (usually $7 \text{ dB}$).
- Noise Nuisance: This is "subjective." It is any noise that disturbs or impairs the peace and convenience of another person (e.g., a screaming party, a barking dog, or a sound system). This is illegal at any hour, not just at night.
2. Official "Quiet Hours"
While you must be considerate 24/7, the municipality enforces stricter "disturbance of peace" rules during these specific windows:
- Sunday – Thursday: 21:30 (9:30 PM) to 07:00 AM.
- Friday – Saturday: 00:00 (Midnight) to 08:00 AM.
3. Penalties
If the Metro Police or a Noise Control Officer determines the noise is a violation, they can:
- Issue an on-the-spot fine (typically ranging from R1,500 to R40,000 depending on the severity).
- Confiscate the equipment (speakers, amplifiers, etc.) causing the noise.
- In extreme or repeat cases, the offender can face up to 2 years in prison.
4. How to Report a Complaint
If a party or neighbor is violating these rules, you should follow these steps:

Pro-tip: When you call Metro Police, always ask for a reference number and the name of the officer who took your call. If the noise doesn't stop, you will need that reference number to escalate the matter to your local Ward Councillor or the SAPS Station Commander.
